Terms & Conditions
These Terms & Conditions ("Terms") govern your use of sealmyrecordma.com (the "Site") and the record-sealing preparation services (the "Services") offered by the Law Office of Patrick T. Donovan ("we," "us," or "our"). By using the Site or purchasing the Services, you agree to these Terms.
What the Services are
We provide attorney-reviewed preparation for Massachusetts criminal record sealing under G.L. c. 276 §§ 100A (convictions) and 100C (non-convictions). The Services help you check eligibility, identify the correct path, complete the appropriate Petition to Seal, and prepare to file it yourself. You file your own petition with the Office of the Commissioner of Probation (§100A) or the appropriate court (§100C). Paid packets include the completed petition, filing or mailing instructions, a document checklist, and up to three written questions to the reviewing attorney through your dashboard; the Guided tier adds a consultation of up to 30 minutes.
What the Services are not
- We do not provide court representation or appear in court or before the Commissioner of Probation on your behalf, and we do not file or mail the petition for you.
- We do not handle expungement (G.L. c. 276 §§ 100E–100U). Matters that involve a contested hearing beyond a standard §100C sealing hearing, an active or related criminal case, or anything outside the single Massachusetts record-sealing matter you submit are outside the scope of the Services; if your matter is outside our scope, we will tell you and refund you.
- Nothing on the Site guarantees that any record will be sealed, or any particular outcome. Eligibility and the final decision rest with the Commissioner of Probation (§100A) or the court (§100C).
Attorney-client relationship
An attorney-client relationship is formed only upon (1) your purchase of a Services package, (2) our acceptance of your matter after review, and (3) any required engagement confirmation. We reserve the right to decline any matter. The attorney review and any consultation provided as part of a package relate solely to the prepared materials and the scope described.
Eligibility information
Eligibility tools and content provide preliminary, general guidance only. Eligibility depends on the specifics of your record and current law, and is confirmed only through attorney review. Do not rely on any automated result as a determination that you qualify.
Payment, trust, and refunds
- Prices are the flat fees shown on the Site ($149 Solo, $299 Guided), charged one time through our third-party processor, LawPay/AffiniPay. Because each flat fee is under $500, a separate written fee agreement is not required (Mass. R. Prof. C. 1.5(b)(2)); these Terms, the checkout screen, and your receipt state the scope and fee.
- There is no government or court fee to seal a criminal record in Massachusetts; package prices cover preparation and attorney review only.
- Fees are held in a Massachusetts attorney trust account (IOLTA) under Mass. R. Prof. C. 1.15 until earned. The fee is earned when the attorney reviews and signs your packet.
- Refunds: full refund any time before the attorney begins reviewing your packet; full refund if we cannot accept your matter (a conflict, ineligibility we should have caught, or a matter outside our scope). Any unearned portion of a fee is returned consistent with Mass. R. Prof. C. 1.16(d).
Your responsibilities
You agree to provide accurate, complete information; to review your prepared materials before filing; and to meet any filing steps and instructions yourself. We are not responsible for outcomes affected by inaccurate information you provide or by your failure to follow instructions.
Intellectual property
The Site, its content, and its tools are owned by us or our licensors and are provided for your personal use in connection with the Services. You may not copy, resell, or redistribute them.
Disclaimers and limitation of liability
The Site and Services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability for any claim arising out of the Services is limited to the amount you paid for the applicable package. Nothing in these Terms limits any liability that cannot be limited under applicable law or the Massachusetts Rules of Professional Conduct.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. Disputes shall be brought in the state or federal courts located in Massachusetts.
Changes
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
